## TL;DR

Spain's 2021 law gives adults with a serious and incurable illness, or a serious, chronic and disabling condition, the right to request help to die, after two written requests at least 15 days apart and information about palliative care.

## Summary

Spain, organic law of 24 March 2021, published in the Boletín Oficial del Estado on 25 March 2021 (BOE-A-2021-4628) and in force three months after publication. Article 5 sets the requirements to receive the 'prestación de ayuda para morir': Spanish nationality, legal residence or registered residence of more than twelve months; being of age and capable and conscious when requesting; having in writing the information on the medical process and alternatives, including access to comprehensive palliative care; two voluntary written requests at least fifteen calendar days apart (a shorter interval is allowed if loss of capacity is imminent); suffering from a serious and incurable illness or a serious, chronic and disabling condition, certified by the responsible doctor; and informed consent. Where the person has lost capacity, a prior advance directive or living will can stand in for the requests.
