Its own page describes the legal framework as fixing a deadline of 180 days, extendable by a further 90, for a decision, and requires the analysis to rest on scientific evidence of efficacy, accuracy, effectiveness and safety and on a comparative economic evaluation against technologies the system already provides. A product must be registered with ANVISA before it can be assessed, and a medicine must also have its price regulated by the drug-pricing chamber CMED.\n\nThe commission works through three committees (medicines; products and procedures; clinical protocols), each with 17 voting member institutions, with the National Council of Justice, the National Council of the Public Prosecutor's Office and the public defenders' council taking part without a vote. Any person or organisation, including a patient, can ask for a technology to be assessed. Public consultations come with a plain-language report for society, and patients can give testimony on the condition and the technology (Perspectiva de Paciente).\n\nA CONITEC recommendation is not the end of the road for a patient. The Ministry of Health announced in May 2026 that 23 high-cost cancer medicines, already incorporated, had waited up to 12 years to reach patients until a new funding table provided for them. For private health plans, the regulator ANS adds technologies that the SUS has incorporated on CONITEC's recommendation to its own coverage list within 60 days of the incorporation order. When a court is asked to order a medicine that is not on the SUS lists, CONITEC's page sets out the Supreme Federal Court's conditions, among them that CONITEC's refusal was unlawful or that no request was made or its analysis was excessively delayed.","asOf":"2026-11-03","links":[{"label":"CONITEC: Conheça a Conitec (what the commission is and its deadlines)","url":"https://www.gov.br/conitec/pt-br/assuntos/a-comissao/conheca-a-conitec"},{"label":"CONITEC: Judicialização (the Supreme Court's conditions for court-ordered medicines)","url":"https://www.gov.br/conitec/pt-br/judicializacao"},{"label":"INCA: SUS offers 23 new medicines for cancer treatment (21 May 2026)","url":"https://www.gov.br/inca/pt-br/assuntos/noticias/2026/sus-oferece-23-novos-medicamentos-para-o-tratamento-do-cancer"}],"tags":[],"related":[],"cancers":[],"sections":[],"technologies":[],"targets":[],"drugs":[],"companies":[],"institutions":["anvisa","ans-brazil","inca-brazil"],"pathways":[],"terms":["real-world-evidence"],"trials":[],"people":[],"bottlenecks":["b-drug-pricing","b-global-access"],"keyPapers":[],"journals":[],"dependsOn":[],"notes":[],"provenance":{"editedBy":"OnCo country deep dive, Brazil (wave 2)","editedOn":"2026-11-03"},"city":"Brasília","country":"BR","lat":-15.799,"lng":-47.864,"institutionType":"government","website":"https://www.gov.br/conitec/pt-br","programs":["Health technology assessment for the SUS","Clinical protocols and therapeutic guidelines (PCDT)","Public consultations with plain-language reports","Patient perspective testimony"]},"route":"/institutions/conitec/","neighbours":{"institution":[{"id":"ans-brazil","kind":"institution","name":"Agência Nacional de Saúde Suplementar","route":"/institutions/ans-brazil/"},{"id":"anvisa","kind":"institution","name":"Agência Nacional de Vigilância Sanitária","route":"/institutions/anvisa/"},{"id":"inca-brazil","kind":"institution","name":"Instituto Nacional de Câncer (INCA)","route":"/institutions/inca-brazil/"}],"term":[{"id":"real-world-evidence","kind":"term","name":"Real-world evidence","route":"/terms/real-world-evidence/"}],"bottleneck":[{"id":"b-global-access","kind":"bottleneck","name":"Most of the world has almost no cancer care","route":"/bottlenecks/b-global-access/"},{"id":"b-drug-pricing","kind":"bottleneck","name":"Prices and value","route":"/bottlenecks/b-drug-pricing/"}]}}
